1. Acceptance of Terms

By accessing or using PhotoPass (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

PhotoPass is an online passport and ID photo service that uses AI technology to help you create government-compliant photos. The Service includes:

• AI-powered automatic cropping and face positioning
• Browser-based background removal (your photo never leaves your device for this step)
• Compliance verification checks
• Digital photo delivery via email
• Print-ready JPEG and 4×6″ print sheet

3. Acceptance Guarantee

To claim a refund under this guarantee:

• Contact us within 30 days of your purchase
• Provide proof of rejection from the government authority (e.g., rejection letter or screenshot)
• The rejection must be for a photo compliance issue — not for unrelated application problems

4. Pricing & Payment

• All prices are listed in USD
• Payment is processed securely by Stripe — we never see your card details
• You are charged once at the time of purchase — no recurring charges or subscriptions
• Digital photos are delivered immediately after successful payment

6. User Responsibilities

When using PhotoPass, you agree to:

• Upload only photos of yourself or persons you are legally authorised to represent (e.g., your minor children)
• Provide accurate information including your email address
• Not use the Service for fraudulent purposes or to create false identity documents
• Comply with the photo requirements of your target government authority

7. Intellectual Property

You retain full ownership of your photos. By uploading a photo, you grant PhotoPass a temporary, limited licence to process and store it solely for the purpose of delivering your order. This licence expires when your photo is deleted from our servers (within 24 hours of upload).

The PhotoPass brand, website design, and associated intellectual property remain the property of PhotoPass.

8. Limitation of Liability

PhotoPass provides AI-assisted compliance checking, but cannot guarantee acceptance by every government authority in every case. Requirements may change without notice, and individual officers may apply different standards.

Our total liability for any claim arising from use of the Service is limited to the amount you paid for the specific order in question.

9. Service Availability

We strive to keep PhotoPass available 24/7, but do not guarantee uninterrupted service. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control.

10. Changes to Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration or the jurisdiction agreed upon in writing between the parties.
